These Terms and Conditions ("Terms") govern access to and use of the Selfbrain service ("the Service"), including the Telegram bot, the selfbrain.ai website, APIs, and all related services.

By using Selfbrain, you agree to these Terms in their entirety. If you do not agree, do not use the Service.

1. Description of Service

Selfbrain is an AI personal assistant accessible through Telegram. It offers features such as AI chat, voice transcription, document analysis, video processing, Google Drive/Calendar integration, scheduled tasks, and an affiliate program.

We offer free and paid plans with different levels of functionality.

2. Eligibility

• You must be at least 16 years of age.
• You must have an active Telegram account.
• You are responsible for maintaining the security of your Telegram account.
• You must provide truthful information during registration.

3. Acceptable Use

You agree NOT to use Selfbrain to:

• Generate, store, or distribute illegal, defamatory, obscene, threatening, discriminatory, or hate-inciting content.
• Violate third-party intellectual property rights.
• Generate spam, phishing, or misleading content.
• Attempt to access other users' accounts.
• Abuse usage limits, create multiple accounts to circumvent restrictions, or manipulate the referral system.
• Send files containing malware, viruses, or malicious code.
• Use the service for fraudulent activities or money laundering.
• Reverse-engineer or attempt to extract AI models.
• Use the service output to train other AI models without authorization.
• Any use that violates applicable local, national, or international laws.

4. AI-Generated Content

IMPORTANT: Responses generated by Selfbrain are produced by third-party artificial intelligence models (Anthropic Claude, Meta Llama, DeepSeek, etc.) and may:

• Contain errors, inaccuracies, or outdated information.
• Not be appropriate for all contexts.
• Not constitute professional advice (legal, medical, financial, etc.).

Liberty Digital LLC does not guarantee the accuracy, completeness, suitability, or reliability of any AI-generated response. The user is solely responsible for verifying and validating any information before acting upon it.

5. User Responsibility for Content

You are solely responsible for:

• All content you send to the bot (messages, files, images, videos, voice notes).
• All content you generate using the Service.
• How you use, publish, or distribute generated content.
• Ensuring that files you send are your property or you have permission to process them.

Liberty Digital LLC assumes no responsibility for content generated, modified, or distributed by users through the Service.

6. Payments and Subscriptions

• Payments are processed through Stripe Inc.
• Prices are displayed in US Dollars (USD).
• Subscriptions automatically renew at the end of each period (monthly or annual).
• You may cancel your subscription at any time. Cancellation takes effect at the end of the paid period.
• No refunds are issued for partial periods, except where required by applicable law.
• We reserve the right to modify prices with 30 days' notice.

7. Affiliate Program

• 20% recurring commission for direct referrals (Level 1) for 12 months.
• 5% recurring commission for second-level referrals (Level 2) for 12 months.
• Minimum payout threshold: $25.00 USD accumulated.
• Monthly payments via Stripe Connect.
• Spam, misleading advertising, or manipulation of the referral system is prohibited.
• We reserve the right to suspend or cancel affiliate participation without prior notice if abuse is detected.
• Commissions generated from fraudulent referrals will be withheld and accounts suspended.

8. Intellectual Property

• The Service, including its code, design, brand, and content, is the property of Liberty Digital LLC.
• Content you generate using the Service belongs to you, subject to the licenses of the AI models used.
• You grant us a limited license to process your content for the purpose of providing the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Selfbrain is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied.
• Liberty Digital LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Service.
• We are not responsible for the availability, performance, or errors of third-party services (Telegram, Anthropic, OpenRouter, Stripe, Google, Cloudflare, Replicate, etc.).
• We are not responsible for data loss, revenue loss, business opportunity loss, or any other economic damage arising from use of the Service.
• We are not responsible for content generated by AI models or actions users take based on such content.
• Our total cumulative liability shall not exceed the amount paid by the user in the last 12 months, or $100 USD (whichever is less).

10. Indemnification

You agree to indemnify and hold harmless Liberty Digital LLC, its directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of third-party rights.
• Content you send or generate through the Service.

11. Suspension and Termination

• We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.
• In case of violation of these Terms, termination will be immediate with no right to refund.
• You may close your account at any time by contacting us by email.

12. Modifications

We reserve the right to modify these Terms at any time. Significant changes will be notified at least 15 days in advance through the bot or by email. Continued use of the Service after notification constitutes acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Bernalillo County, New Mexico, USA.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
